Five suspects, including a police officer, appear in court as prosecutors oppose their release on bail in the Dr. Victoria Mutiso murder case.
The State has opposed bail for five suspects facing murder charges over the killing of clinical psychologist Dr Victoria Nthunya Mutiso.
The suspects appeared before Milimani High Court Judge Alexander Muteti on Tuesday, September 29, 2026, for plea-taking. They include Rose Mbithe Mulwa, Chris Mulwa, Angela Mulwa, Police Constable Elijah Kibelion Kimoi and Maritim Kimutai. The five have pleaded not guilty to the murder charge as the case enters a new stage.
Dr Mutiso was fatally shot on July 29, 2026, in Nairobi. Investigators have since pursued several suspects in connection with the killing, while prosecutors now want the five accused to remain in custody as the case proceeds.
State Raises Witness Interference Fears
The prosecution has opposed the suspects’ release, citing concerns over possible interference with witnesses and the ongoing investigations. The State argues that some witnesses remain vulnerable and could face intimidation if the accused regain their freedom. Prosecutors have also raised concerns over alleged links to other people who remain at large.
The involvement of a serving police officer has added another layer to the prosecution’s concerns. Investigators fear that access to police resources could interfere with the investigation or expose witnesses to further risks.
Property Dispute Emerges in Case
The murder investigation has also touched on a long-running property dispute involving Dr Mutiso and her husband. Investigators have cited allegations involving property in Mlolongo, including claims surrounding a forged title deed and the destruction of property valued at about KSh37 million.
The defence has previously disputed aspects of the prosecution’s account of the property dispute. However, prosecutors maintain that the matter forms part of the wider circumstances under investigation.
Lawyers Withdraw From Defence Team
Tuesday’s proceedings also brought a major change to the defence team. High-profile lawyers Danstan Omari and Cliff Ombeta withdrew from representing Rose Mbithe and her two children, Chris and Angela Mulwa. The accused reportedly raised no objection to the lawyers’ withdrawal.
The development leaves the three accused facing the next stage of proceedings under new legal representation.
The defence is expected to respond to the State’s opposition as the court considers the bail applications. Meanwhile, the prosecution wants the accused to remain in custody to protect witnesses and preserve the integrity of the case.
The five suspects have pleaded not guilty and remain presumed innocent unless the court proves the charges against them. The High Court will determine the next steps as the murder case continues.
