The court directed the prison terms to run alongside Waititu’s existing sentence and imposed Ksh22 million in fines on his wife.

The Milimani High Court has imposed fines totalling Ksh21 million in the Waititu graft case, with alternative prison terms totalling 13 years. The case concerns Ksh588 million allegedly siphoned from Kiambu County during Ferdinand Waititu’s tenure as governor.

Justice Harrison Barasa delivered the sentence on Monday, November 2, covering three money-laundering counts. However, the court directed the prison terms to run concurrently with Waititu’s existing 12-year sentence, rather than consecutively.

On Count 10, Barasa imposed a Ksh10 million fine or five years in prison. The other two counts each carry alternative four-year prison terms, bringing the total to 13 years.

Before sentencing, the judge considered the accused persons’ mitigation and the prosecution’s submissions. He also weighed the seriousness of the offences and the relevant legal provisions.

The concurrency order follows directions in an October 14, 2026 High Court ruling. In paragraph 317 of that judgment, Justice Rose Ougo addressed the three money-laundering counts.

Ougo directed that those sentences run alongside penalties previously imposed under the Anti-Corruption and Economic Crimes Act. Waititu’s existing 12-year prison sentence dates to February 2025 in another graft case.

Meanwhile, the court imposed fines totalling Ksh22 million on Waititu’s wife, Susan Wangari, across the three money-laundering counts. She received a Ksh12 million fine on Count 10.

On Count 11, Wangari faces a Ksh2 million fine or two years in prison. The court also fined her Ksh8 million on Count 12.
