Rose Mbithe Mulwa, her two children and a police constable are expected to answer murder charges before the High Court in Nairobi.
Rose Mbithe Mulwa and her two children, Angela Mulwa and Chris Mulwa, are due before the High Court in Nairobi on September 29 to enter pleas in the case concerning the killing of psychiatrist Dr Victoria Nthunya Mutiso.
According to Capital FM, Justice Alexander Muteti ordered that the three appear in court at noon after being informed that they had not taken part in Wednesday’s proceedings through a virtual connection.
Police Constable Elijah Kibelion Kimoi, who was later added to the case as a fourth suspect, is also expected to answer the murder charge on the same date.
Court orders physical appearance
A prison officer told the court that Mbithe and Angela had declined to participate remotely from Lang’ata Women’s Prison, where they are being held. Justice Muteti then ordered their physical attendance for plea-taking.
The court also heard that the files concerning the accused would be combined so that those facing charges over Dr Mutiso’s death could enter their pleas together.
The scheduled appearance follows earlier court sessions in which the suspects were presented before the High Court but did not plead. September 29 is therefore the next scheduled step in proceedings, rather than a determination of the allegations against them.
Mental assessments preceded plea-taking
The Director of Public Prosecutions approved murder charges after preliminary investigations by the Directorate of Criminal Investigations. Mbithe and her children were initially expected to take plea following that decision.
However, Justice Kanyi Kimondo directed that they first undergo mental assessments to determine whether they were fit to plead, delaying the process. The source report does not detail the findings of those assessments.
The prosecution alleges that the four accused, acting with others not before the court, killed Dr Mutiso along Mawensi Road in Kilimani, Nairobi County, at about 9.30am on July 29, 2026. The charge is brought under Section 203, read together with Section 204, of the Penal Code.
Investigators examine circumstances of killing
Dr Mutiso, a psychiatrist who previously served as director of the African Institute of Mental and Brain Health, was shot dead while travelling in a taxi in Nairobi.
Capital FM reported that, before her death, she had reported a separate encounter near Junction Mall on Ngong Road in which two armed men on a motorcycle allegedly confronted her.
Investigators have also examined a longstanding property dispute involving Dr Mutiso’s family and Mbithe, who was formerly married to Dr Mutiso’s husband, Professor David Musyimi Ndetei.
That alleged dispute forms part of the prosecution’s account of the investigation. It does not establish responsibility for the killing, and the murder allegations against all four accused remain unproven in court.
