Court Fast-Tracks Jicho Pevu’s KSh 17B Waste Suit
Nyali MP Mohamed Ali has secured an early win against the County Government of Mombasa. The High Court has certified his petition on the KSh 17 billion waste project as urgent.
Court Demands Swift Action
Consequently, Justice Jairus Ngaah ruled that the petition raises serious constitutional and procurement issues. He ordered all respondents to be served immediately. Moreover, he gave them seven days to file their replies. The court will then issue further directions on December 15, 2025.
Ali Challenges the Project’s Approval
Meanwhile, Ali says county officials approved the costly project through irregular steps. He states that no tender notice was published. He adds that no public participation took place. Furthermore, he says the County Assembly failed to approve the project as required by law.
County Accused of Hiding Procurement Records
Additionally, Ali claims the county withheld crucial procurement documents. He says his requests received incomplete responses. He argues that this conduct violates Article 35 and the Access to Information Act. As a result, he believes the county denied the public key details about the project’s funding and approval.
Ali Seeks Nullification and Investigations
Ali asks the court to nullify all irregular tenders linked to the project. He wants the county compelled to release every procurement record. He also seeks investigations by the EACC and the PPRA. Ultimately, he says only a full inquiry can confirm whether public money was put at risk.
Ali Reaffirms His Push for Accountability
Afterward, Ali restated his commitment to justice and transparency. He confirms that all respondents are now being served.

Next, the High Court will issue new directions on December 15. The ruling offers a major boost to Ali’s push for accountability in one of Mombasa’s most contested projects.
