Former Nairobi Provincial Commissioner Nathan Davis Chelogoi received a three-year prison sentence.
A court sentenced former Nairobi Provincial Commissioner Nathan Davis Chelogoi despite his lawyer’s plea for a non-custodial sentence.
A court has ordered former Nairobi Provincial Commissioner Nathan Davis Chelogoi jailed for three years over unlawful possession of property. The property belongs to businessman Ashok Shah and lies in Lower Kabete, Nairobi County.
Trial Magistrate Dolphina Alego ruled that the prosecution had proved its case beyond reasonable doubt. However, Chelogoi’s defence disputed that he had taken possession unlawfully.
Chelogoi jailed despite plea over age and health
During mitigation, lawyer Assah Kiprono asked the court to spare his 76-year-old client a prison term. He cited Chelogoi’s age and deteriorating health in seeking a non-custodial sentence.
Kiprono also maintained that the government had allocated the property to Chelogoi during former President Daniel arap Moi’s administration. On that basis, he argued that his client had not taken possession of the land unlawfully.
The lawyer further told the magistrate that a dispute over the same property remained before the Environment and Land Court. He urged the court to consider Chelogoi’s personal circumstances when deciding the sentence.
Despite those submissions, the court imposed a three-year prison term following its finding of guilt. Kiprono also requested typed court proceedings to enable him to appeal against the conviction.
