The DPP has directed the DCI to examine the roles of county officials, the developer and construction professionals in the Nairobi collapse.
The Director of Public Prosecutions has ordered a criminal investigation into the Eastleigh building collapse in Nairobi. The probe will examine the circumstances surrounding the multi-storey building’s collapse, including possible failures by those involved in its construction.
In a statement on Monday, the Office of the Director of Public Prosecutions (ODPP) directed the Directorate of Criminal Investigations to investigate. The directive comes amid questions about compliance with construction rules.
Eastleigh building collapse probe to examine officials’ roles
The investigation will establish whether actions or omissions by Nairobi City County Government officials contributed to the collapse. It will also examine the roles of the private developer, contractors and other professionals involved.
The DPP further said Nairobi City County Government had not submitted any inquiry file concerning the building’s construction. Such a file would allow the ODPP to review possible wrongdoing and provide directions.
Prosecution will depend on evidence
Once investigators complete their work, the DCI will submit its findings to the ODPP for independent review. The office will then assess whether the evidence establishes criminal responsibility and warrants prosecution.
Any prosecution will therefore depend on sufficient evidence against those implicated. However, the ODPP stressed that a person’s position or status would not shield them from action.
The office also said it would address any conduct amounting to a criminal offence in line with the law.
