A Nairobi court has convicted Kelly Gichuri Muiruri of using a forged KCSE certificate to secure a driver’s job. The court found that he fraudulently obtained Ksh6,742,673 from Nairobi City Water and Sewerage Company through the employment.

In addition to compensation, the court imposed separate fines for each of the four offences. Each fine carries a default prison term if Muiruri fails to pay.

For fraudulent acquisition of public property, Muiruri must pay Ksh300,000 or serve 12 months in prison. Meanwhile, the offence of uttering a false document attracted a Ksh200,000 fine, with eight months in jail in default.

The court also fined him Ksh200,000 for deceiving a principal, with an eight-month default prison term. For presenting a forged certificate, it imposed a Ksh100,000 fine or eight months in prison.

In determining the sentence, the court considered the prevalence of offences involving fraudulent documents. It noted that using such documents to secure employment and public funds had become a serious economic crime.

The court also took into account the prosecution’s submissions on the appropriate sentence.
