A Nairobi court has denied bail to Sammy Murigi Maina, the driver accused in a fatal Enterprise Road crash. Milimani Principal Magistrate Paul Mutai ruled on Thursday, September 24, 2026, that Maina will remain in custody until key prosecution witnesses testify. The court also ordered that Maina receive medical treatment at a hospital while in custody.
Witness Protection Concerns
Magistrate Mutai found that the prosecution had presented compelling reasons for denying bail. The court raised concerns about possible interference with key witnesses.
It also considered questions surrounding Maina’s whereabouts after the June crash. Prosecutors told the court that Maina remained untraced for nearly two months.
He was eventually arrested after investigators tracked him outside Nairobi. The court also noted conflicting accounts about his place of residence. These concerns influenced the decision to keep him in custody.
Enterprise Road Crash
The case stems from a June 3, 2026 crash along Enterprise Road. The incident happened at around 8pm near KCB Bank in Nairobi’s Industrial Area.
Maina was driving an Isuzu minibus, registration KDU 887C, operated by Risen Sacco. According to the prosecution, the vehicle lost control while negotiating a roundabout.
It allegedly hit the kerb before overturning across the road. Three passengers died in the crash. They were Charles Brandy Wahome, Tamia Kalekye Nyambura and Edwin Kago.
Maina Faces Multiple Charges
Maina faces three counts of causing death by dangerous driving. He also faces charges linked to careless driving and an allegedly unroadworthy vehicle.
The prosecution has linked the crash to alleged “Manyoka” driving. Maina has denied the charges. The case will now proceed with prosecution witnesses expected to testify.
