The driver of the D’etat matatu involved in the fatal Enterprise Road accident has been arrested and charged nearly three months after the crash.
Sammy Murigi Maina appeared before Milimani Magistrate Paul Mutai on Thursday, September 17, 2026, where he faced charges of causing death by dangerous driving.
Fatal Enterprise Road Crash
The accident occurred on Wednesday, June 3, 2026, at around 8pm along Enterprise Road in Nairobi. According to the charge sheet, Maina was driving an Isuzu minibus registration KDU 887C, operated by Risen Sacco.
The prosecution alleges that he drove recklessly and dangerously before losing control while negotiating a roundabout opposite KCB Bank.
The vehicle hit a kerb, overturned and landed across the road. The crash killed passengers and injured others.
The charge sheet names Charles Wahome, Tamia Kalekye and Edwin Kago among those who died. Maina faces three counts under Section 46 of the Traffic Act.
Driver Allegedly Fled After Crash
Reports surrounding the incident indicated that the driver remained at large after the accident.
On September 3, 2026, Milimani Court had already ordered police to produce Maina within 14 days after nearly two months without him appearing in court. The latest court appearance followed his eventual arrest.
Court Case Continues
The case has also raised questions about the handling of the matatu as evidence. Victims’ lawyers previously told the court that police at Industrial Area Police Station had released the vehicle to its owner for refurbishment despite its importance to the investigation.
Maina will now face the court over the alleged dangerous-driving offences as the case proceeds. The charges are allegations, and the accused remains entitled to the presumption of innocence unless proven guilty in court.
