Politician Rose Mbithe Mulwa, her two children and two police officers have denied murdering prominent lawyer Mathew Kyalo Mbobu.

The five accused appeared before Lady Justice Diana Kavedza at the Kibera High Court on Tuesday, October 27, 2026. They pleaded not guilty to the murder charge.

The prosecution alleges that the accused, together with other individuals who have not been arraigned, killed Mbobu on September 9, 2025. The alleged offence occurred at around 7:30 p.m. along Magadi Road in Karen, Nairobi.

Five Face Murder Charges

The accused persons are Rose Mbithe Mulwa, her children Chris Mulwa and Angela Mulwa, and police constables Julius Kipkoech Cheruiyot and Kennedy Kipkemoi Borboroi.

The case marks a second murder charge for Rose and her two children. They are also facing separate charges linked to the killing of psychologist Dr Victoria Mutiso.

However, the charges remain allegations. The accused persons have denied the allegations and are entitled to the presumption of innocence as the cases proceed through court.

Inspector Kenneth Sang Under Investigation

The prosecution has also disclosed plans to charge Police Inspector Kenneth Sang in connection with Mbobu’s murder.

Sang was arrested in Eldoret as detectives pursued investigations into the lawyer’s killing and the separate case involving Dr Mutiso.

A court granted investigators 14 days to detain Sang while they complete outstanding inquiries. However, he was not among the five accused persons who entered pleas in the Mbobu case on Tuesday.

Court Sets Bond Hearing

Justice Kavedza directed the prosecution to file an affidavit opposing the accused persons’ release on bond. The court scheduled November 24, 2026, for the hearing of their bond application.

The proceedings will determine whether the accused can secure release while awaiting trial. The prosecution and defence are expected to present their respective arguments before the court makes its decision.

Who Was Mathew Kyalo Mbobu?

Mbobu was a prominent advocate of the High Court, university lecturer and author. His death shocked members of Kenya’s legal fraternity.

According to the post-mortem findings reported in the case, Mbobu sustained eight gunshot wounds to his chest, neck and chin.

Investigators have continued examining the circumstances surrounding the fatal shooting and the alleged involvement of the accused persons.

As the case progresses, the prosecution will be required to present evidence supporting its allegations. The court will ultimately determine the responsibility of each accused person based on the evidence presented.
